E-Commerce Terms and Conditions

  1. Background information
    1. These terms and conditions govern the purchase of products (referred to as Goods) from the Lalys Pharmacy website (lalyspharmacy.co.uk: the Website) by you, the customer. These terms are in addition to our general terms and conditions for the use of the Website.
    2. Lalys Pharmacy (also referred to as we, us or ours) is a trading name of J C L (UK) Limited and therefore if you purchase products from the Website your contract will be with J C L (UK) Limited.
    3. We are authorised to sell medicines online by the Medicines and Healthcare products Regulatory Agency (MHRA) authorisation scheme. Our registration number is C44977. Details and terms of the scheme can be found here.
    4. The sale of Goods through the Website are subject to the Consumer Contract Regulations 2013 and the Consumer Rights Act 2015.
  2. Online transactions and orders
    1. Registration
      You must register to make a purchase. Information about how we use your details is set out in our Privacy Policy.
    2. Age restrictions
      You must be 18 years old or older to make a purchase.
    3. Location
      We will only deliver Goods purchased to a United Kingdom address.
    4. Ordering, offers and acceptance and creation of a contract
      You may submit an offer to purchase particular Goods offered on the Website. Such an offer, whether done by submitting an order form, web enquiry or other statement to similar effect does not create a binding contract between us and you.
      On receipt of your order we will send you confirmation that we have received your order and either confirm acceptance of your order or inform you that we are unable to accept the offer, for example because we do not have the relevant Goods in stock.
      Where you are required to make payment on submission of any order you will not be deemed to have submitted an order where the payment is not authorised.
      An order may not be accepted by us for the following reasons (this list is not exhaustive):

      • We do not have the Goods in stock
      • We are unable for organisational reasons to fulfil the order
      • Due to a pricing or product description error
      • Due to legal, postal or other restrictions meaning that you are not eligible to order the selected Goods
      • Due to legal restrictions meaning we can only supply a certain quantity of certain Goods
      • Due to a failure to obtain authorisation for any payment

      Your order will be accepted and the contract concluded when we have sent you written confirmation that we have accepted your order, have confirmed that we are able to supply the Goods ordered and have received full or part payment as required and notified to you.

      The contract will be concluded in English.

      Any concluded contract will not be filed by Lalys Pharmacy.

    5. Cancellation and return of goods
      You may cancel the contract and receive a refund for any Goods within 14 days of the date you received the goods except where the goods supplied:

      • Are likely to deteriorate or expire rapidly
      • Are sealed for hygiene or health protection reasons and the seal has been broken

      You have the right to reasonably inspect your Goods but should not break any hygiene seals. You cannot return Goods which have been used except where they are faulty (please see section 2.6 below).

      In order to cancel the Goods you can submit our standard cancellation form, which can be found here. If you submit the form online we will send you a written confirmation by email that we have received notice of cancellation.

      Alternatively you can make a clear statement that you wish to cancel the order for the Goods in writing or by telephone to:

      The notice of cancellation must be sent before the end of 14 days from the date on which the Goods were delivered.

      You will be liable for the costs of returning the goods to us and must return them within 14 days of receipt. You shall ensure that the means used to return the Goods is appropriate to the nature and value of the goods. Goods should be returned to:

      You will receive a refund for the full value of the goods except where the value of the Goods has diminished because you have unnecessarily handled the Goods beyond what was required to establish their nature, characteristics and functioning; in which case we will be entitled to reduce the refund according to how far the goods have diminished, which may be up to 100% of the total excluding postage costs.

      We will refund to you the full cost of delivery of the Goods, except where you selected an enhanced delivery option, in which case we will refund the cost of the standard delivery option.

      Any refund payable to you will be made within 14 days of receipt by us of the returned Goods. The refund will be paid by the same method as your original payment unless agreed by you otherwise or if not possible.

      Your right of cancellation only applies to the contract as a whole. If you wish to return only some of the Goods this is at our discretion.

    6. Return of goods which are faulty, not fit for purpose or not as described
      In addition to your rights above at 2.2 you may also return Goods to us which are:

      • Not of satisfactory quality, i.e. faulty
      • Not fit for purpose
      • Not as described

      This right does not apply to Goods which are faulty due to wear or tear.

      Your right to return such Goods lasts for 30 days from the date on which you received the Goods.

      Where the Goods are capable of repair or replacement then you may request that the Goods are repaired or replaced or we may repair or replace the Goods rather than offer a refund. If you ask us to repair or replace the Goods we will do so unless it is not possible for us to do so or if the cost or process to do so would be disproportionate as opposed to providing a refund.

    7. Prices
      All prices are in Pound Sterling and are inclusive of VAT unless stated otherwise.
    8. Postage and packaging
      The cost and means of delivery will be notified to you prior to checkout when you enter your delivery postcode.
    9. Purchase and use of medication
      Not all medicines are suitable for all persons or all medical conditions and you should consult your General Practitioner if you are unsure if any medication we sell is suitable.
      All medication should be taken in accordance with the manufacturers instructions.
    10. Limit of liability
      Our total liability to you in respect of this contract will be the total price paid for the products, except in respect of personal injury or death or fraudulent misrepresentation.
    11. Governing jurisdiction
      These terms and the contract formed between us shall be governed by the law of England and Wales, unless you live in Scotland or Northern Ireland in which case you may choose for the law of that land to apply.
